If you are a building owner that is considering a rooftop lease, however, there are very significant risks involved and I strongly suggest that you hire an attorney to assist you in the transaction. The leases are often fairly complex and revisions are generally necessary to protect the rights of the property owner, especially as relating to the integrity of the roof, the term, and the impact it will have on the future uses and value of the building. There is also generally an easement that is recorded against the property, which should also be reviewed by an attorney, as they are often more restrictive than they should be.
